1. Acceptance of terms

By creating an account, accessing, or using the DamaSky platform and related services ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Accounts

Registration. You must provide accurate, current, and complete information when creating an account, and keep it up to date.

Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at privacy@damasky.com [TO CONFIRM] if you suspect unauthorized access.

One account per entity. Each account is for a single business entity. Sharing accounts across unrelated organizations is not permitted.

Age. You must be at least 18 years old to use the Service.

3. Subscriptions and billing

Plans. DamaSky offers tiered subscription plans as described on our pricing page. Features and limits vary by plan.

Payment. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annual, as selected). All fees are in US Dollars (USD) and are exclusive of applicable taxes.

Renewal. Subscriptions renew automatically at the end of each billing period. You may cancel at any time to prevent renewal; cancellation takes effect at the end of the current billing period.

Price changes. We may change subscription prices with at least 30 days' advance notice. Continued use after the price change date constitutes acceptance.

Refunds. All payments are non-refundable except as required by applicable law or as expressly stated in a separate agreement.

Taxes. You are responsible for any applicable taxes, duties, or similar charges imposed by your jurisdiction.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable regulations, including the law of your own jurisdiction
• Send spam, unsolicited bulk messages, or engage in any form of abusive messaging
• Upload or transmit malware, viruses, or malicious code
• Attempt to gain unauthorized access to the Service, other accounts, or underlying systems
• Scrape, copy, or reverse-engineer any part of the Service
• Use the Service to harass, defame, or harm others
• Violate the intellectual-property rights of DamaSky or third parties
• Resell or sublicense the Service without our written consent

We reserve the right to suspend or terminate accounts that violate this policy.

5. Intellectual property

DamaSky IP. All rights, title, and interest in the Service — including software, design, trademarks, and content created by DamaSky — belong exclusively to DamaSky or its licensors. These Terms do not grant you any ownership rights in the Service.

Your content. You retain full ownership of the data, content, and materials you upload to the Service ("Customer Content"). By uploading Customer Content, you grant DamaSky a limited, non-exclusive license to store and process it solely to provide the Service.

Feedback. If you submit suggestions or feedback, you grant DamaSky a perpetual, royalty-free license to use that feedback without restriction.

6. Confidentiality

Each party agrees to keep confidential any non-public information received from the other party that is designated as confidential or should reasonably be understood as confidential given its nature. This obligation does not apply to information that is publicly available, was already known to the receiving party, or must be disclosed by law.

DamaSky will handle your Customer Content in accordance with the Privacy Policy and will not disclose it to third parties except as necessary to provide the Service or as required by law.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DamaSky DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free from security vulnerabilities. You use the Service at your own risk.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• DamaSky's TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO DamaSky IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
• DamaSky WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

Some jurisdictions do not allow certain liability limitations; in those cases, the limitation will apply to the maximum extent permitted by law.

9. Termination

By you. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

By DamaSky. We may suspend or terminate your access immediately if you materially breach these Terms, if required by law, or to protect the Service or other users. We will provide notice where reasonably practicable.

Effect of termination. Upon termination, your right to use the Service ceases. You may export your data before the account is closed. Sections 5, 6, 7, 8, 10, and 11 survive termination.

10. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of [governing jurisdiction — TO CONFIRM WITH COUNSEL]. Any dispute arising from or relating to these Terms or the Service will first be subject to good-faith negotiation. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your account before the effective date.

12. General

Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and DamaSky regarding the Service, and supersede all prior agreements.

Severability. If any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.

No waiver. Failure to enforce any right does not constitute a waiver of that right.

Assignment. You may not assign these Terms without our prior written consent. DamaSky may assign these Terms in connection with a merger, acquisition, or sale of assets.

Language. These Terms are provided in Arabic and English. In the event of a conflict, the governing language follows the governing jurisdiction named above. [TO CONFIRM WITH COUNSEL]
